TCPA Consent Language Requirements for Lead Forms [With templates]

Under increased scrutiny from the Federal Communications Commission (FCC), your lead forms might be in danger.

TCPA Consent Language Requirements for Lead Forms [With templates]

If you intend to contact users from the US through phone calls or text messages, collected through your lead forms, then you need to implement these consent language in your forms today!

What is TCPA Compliance?

TCPA or Telephone Consumer Protection Act (TCPA) is a U.S. federal law that dictates the permissible methods and timing for businesses to communicate with individuals via phone or text. It is recognized as a significant measure against robocalls and spam texts, which is why the TCPA imposes extremely stringent conditions on when and how companies can reach consumers.

Under the Telephone Consumer Protection Act (TCPA), you need prior express written consent before reaching out to leads with marketing calls, SMS, or auto-dialed messages.

That means:

  • You can’t just collect a phone number and start calling
  • You must disclose how and why you’ll contact someone
  • The user must actively agree to receive those communications

What Is One-to-One TCPA Consent?

You may have also heard of TCPA One-to-One Consent which was introduced later to address a common loophole in the lead generation world. Traditionally, lead generators employed broad consent language, allowing multiple companies to contact their consumers based on a single, generalized agreement. Something like this:

By clicking ‘Submit,’ you agree to be contacted via phone, text, or email by [Company A], [Company B], [Company C], [Company D], [Company E], and their partners or affiliates…

But 1 to1 TCPA consent language asks that your customers give individual, explicit permission to each business that contacts them- not just a blanket "I agree" to be contacted by anyone.

According to the latest FCC ruling on lead generation, your TCPA compliant forms must:

  • Clearly list each company contacting the lead
  • Let the user select companies individually
  • Confirm consent isn’t required to receive a product or service

Even though legal challenges have delayed this rule’s enforcement, it’s fast becoming best practice for compliance. So we’re making things easy for you with these TCPA consent language templates that you can use in your lead forms.

Do Not Ignore The Risks of TCPA Non-Compliance

If you find yourself in violation - immediately fix it. Violating TCPA consent requirements isn’t a slap on the wrist, it can cost your business thousands and thousands of dollars per lead.

  • Up to $1,500 per violation
  • Risk of class-action lawsuits
  • Blacklisted domains and phone numbers
  • Damaged brand reputation

Even accidental violations, like forgetting to update your form’s wording, can trigger liability.
